Membership Terms
Kinda Special

These Membership Terms supplement the Kinda Special General Terms & Conditions.
1. Membership Eligibility
Kinda Special is a curated membership community.
Membership is generally available to individuals who:

have successfully completed the Kinda Special application and selection process
-
have attended an initial Kinda Special Guest Event, unless Kinda Special expressly waives this requirement
-
have been admitted to Membership by Kinda Special
There is no entitlement to Membership solely as a result of submitting an application or attending an event.
2. Membership Contract
A Membership contract is concluded when the applicant completes the Membership purchase and Kinda Special confirms the Membership.
Membership is voluntary.
Attending a Guest Event does not automatically create a Membership and does not authorise Kinda Special to charge recurring Membership fees.
Membership benefits, fees and billing intervals are displayed during the Membership checkout process.
3. Membership Benefits
An active Membership may include:
• access to Members-only Kinda Special events
• access to the Kinda Special event calendar
• eligibility to purchase Event Tickets
• advance or priority booking opportunities
• selected Members-only gatherings
• community features
• selected partner benefits
• invitations to special formats
• other benefits communicated from time to time
Membership does not guarantee availability of tickets for any particular event.
Unless expressly stated otherwise, Event Tickets are not included in the Membership fee and must be purchased separately.
4. Membership Requirement for Events
Following an individual’s initial Guest Event, participation in Kinda Special events generally requires an active Membership.
Unless expressly stated otherwise, the Member must hold an active Membership both when purchasing a Member Event Ticket and on the date of the respective event.
If a Membership ends before the date of a booked Members-only event, the individual must reactivate their Membership before attending that event.
5. Membership Fees
Membership fees are payable in advance according to the billing period selected during checkout.
All prices shown to consumers include applicable statutory VAT.
Payments may be processed through third-party payment providers.
If payment fails, Kinda Special may temporarily suspend Membership benefits until the outstanding amount has been paid.
6. Duration
Unless a specific minimum term is expressly displayed during checkout, Memberships are concluded for an indefinite period and billed according to the selected billing interval.
The applicable billing interval and price will be clearly displayed before the Membership is purchased.
7. Cancellation of Membership
A Member may cancel Membership at any time with effect from the end of the current paid billing period, unless a different minimum term has been expressly agreed during checkout.
Cancellation does not retrospectively affect Membership fees already due for the current billing period.
Cancellation must be possible through the legally required online cancellation process and may additionally be submitted by e-mail to:
Kinda Special will confirm the cancellation electronically.
Termination for good cause remains unaffected.
8. Termination by Kinda Special
Kinda Special may terminate or suspend Membership for good cause.
Good cause may include:
• serious or repeated violations of the Community Standards
• harassment, discrimination or threatening behaviour
• intentionally providing materially false information during onboarding
• misuse of another person’s account or Membership
• unauthorised resale or repeated attempted transfer of Event Tickets
• significant payment arrears
• fraudulent chargebacks
• behaviour that creates a serious safety risk for other participants
Where appropriate and reasonable, Kinda Special may issue a warning before terminating Membership.
The right of either party to ordinary termination in accordance with the applicable Membership Terms remains unaffected.
9. Consequences of Membership Ending
Once Membership ends, access to Members-only benefits ends.
Future participation in Members-only events requires an active Membership unless Kinda Special expressly agrees otherwise.
Termination of Membership does not automatically create an entitlement to reimbursement of previously paid Membership fees.
Mandatory statutory rights remain unaffected.
10. Right of Withdrawal
Consumers entering into a Membership contract remotely generally have a statutory right to withdraw from the Membership contract within fourteen days without providing reasons.
The withdrawal period begins on the date the Membership contract is concluded.
To exercise the right of withdrawal, the consumer may use the electronic withdrawal function provided on the Kinda Special website or send an unequivocal declaration to:

11. Immediate Start of Membership
If the Member wishes to use Membership benefits before expiry of the statutory withdrawal period, Kinda Special may ask the Member to expressly request that performance of the Membership begins immediately.
Where legally permitted, if the consumer subsequently exercises the right of withdrawal after expressly requesting immediate commencement of the service, the consumer may be required to pay an amount proportionate to services already provided until the date of withdrawal.
12. Refund Following a Valid Withdrawal
Where a valid statutory withdrawal is exercised, Kinda Special will reimburse payments received in accordance with applicable law.
The reimbursement will generally be made using the same means of payment used for the original transaction unless otherwise agreed.
13. Price Changes
Changes to Membership prices will not apply retrospectively to an already paid billing period.
Any price change affecting a future billing period will be communicated before it becomes applicable.
Where the Member’s consent to a contractual price change is legally required, the new price will apply only after the required consent has been obtained.
14. Relationship to General Terms
The Kinda Special General Terms & Conditions additionally apply.
In the event of a conflict regarding Membership-specific matters, these Membership Terms take precedence.
