Event Ticket Terms

Kinda Special

These Event Ticket Terms supplement the Kinda Special General Terms & Conditions and apply to the purchase and use of Kinda Special Event Tickets.

1. Who May Purchase Event Tickets

Kinda Special events are curated events.

An approved applicant may purchase a ticket for their initial Kinda Special event as a Guest where invited or approved to do so.

Following an individual’s initial Guest Event, Event Tickets are generally available only to active Kinda Special Members.

Kinda Special may restrict individual events to particular groups of Members or invitees where this forms part of the event concept.

There is no entitlement to purchase a ticket for a particular event.

2. Booking

A booking becomes binding once the booking has been completed, payment has been successfully received and Kinda Special has confirmed the booking.

Event Tickets must generally be paid in full at the time of booking.

All prices displayed to consumers include applicable statutory VAT.

3. Personal Tickets

Kinda Special Event Tickets are personal.

The ticket is valid only for the Guest or Member named in the booking.

Tickets may not be publicly or privately sold, offered for resale, transferred, assigned or otherwise made available to another person without prior approval from Kinda Special.

This applies in particular to resale through ticket platforms, social media, messaging groups or private networks.

Kinda Special may verify the identity or Membership status of participants at check-in.

An unauthorised recipient of a ticket does not acquire a right of admission.

4. No Statutory Right of Withdrawal for Scheduled Events

Kinda Special Event Tickets relate to leisure activities and experiences taking place on a specific date or during a specific period.

Pursuant to § 312g para. 2 no. 9 German Civil Code (BGB), there is no statutory right of withdrawal for such contracts.

The purchase of an Event Ticket is therefore binding once the contract has been concluded.

The fourteen-day statutory withdrawal right that may apply to a Kinda Special Membership does not apply to the purchase of a scheduled Event Ticket.

5. Cancellation by the Participant

Event Tickets are non-refundable if the Guest or Member is unable or no longer wishes to attend.

A change in personal plans, illness, travel arrangements, work commitments or other circumstances relating to the participant does not in itself create a right to a refund unless required by mandatory law.

Failure to attend an event does not entitle the participant to reimbursement.

6. Release to the Kinda Special Waiting List

As a voluntary service, Kinda Special allows participants to request the release of a booked place to the official Kinda Special waiting list.

The request must be received more than fourteen days before the event.

The participant may not independently choose or nominate a replacement participant.

Kinda Special determines whether an eligible person from the waiting list may take the place.

Releasing a ticket does not constitute a cancellation and does not guarantee reimbursement or Event Credit.

If Kinda Special successfully resells the released place, the original participant will receive an Event Credit equal to the ticket price.

The Event Credit:

• is not redeemable for cash
• may only be used by the original Guest or Member
• may not be transferred
• may be used towards an eligible future Kinda Special event
• expires six months after the date on which it was issued

If the place cannot be resold, no refund or Event Credit is due.

7. Fourteen-Day Cut-Off

Fourteen days or less before an event, tickets can no longer be released for Event Credit.

No refund, Event Credit or replacement participant is due where a participant cancels fourteen days or less before the event.

Kinda Special may make exceptions in individual cases as a gesture of goodwill.

Any such exception does not create an entitlement to similar treatment in future cases.

8. Ticket Transfers

Private ticket transfers are not permitted.

In exceptional circumstances, Kinda Special may approve a replacement participant.

Any replacement participant must meet the applicable Kinda Special admission requirements and must be expressly approved by Kinda Special before the event.

Kinda Special is not obliged to accept a proposed replacement participant.

9. Waiting Lists

Where an event is fully booked, Kinda Special may maintain a waiting list.

Joining a waiting list does not constitute a booking and does not guarantee participation.

If a place becomes available, Kinda Special may offer it to an eligible Guest or Member.

Kinda Special may determine the order in which places are offered based on the event concept, Membership status, community curation and operational requirements rather than exclusively on chronological registration.

10. No-Shows and Repeated Late Cancellations

Because Kinda Special events are deliberately curated around a particular group of participants, late cancellations and no-shows may materially affect the event and other Members.

Repeated no-shows or repeated late cancellations may therefore result in temporary restrictions on advance booking or priority booking privileges.

Any such restriction will be proportionate and communicated to the relevant Member.

Serious or repeated misuse of the booking system may constitute a violation of the Kinda Special Membership Terms.

11. Event Changes

Kinda Special may make reasonable changes to an event where necessary.

These may include changes to:

• programme
• artists or speakers
• menu
• participating partners
• timetable
• individual activities
• venue within the same city or reasonable geographic area

Minor or reasonable changes that do not materially alter the overall character of the event do not create a right to a refund.

Mandatory statutory rights remain unaffected.

12. Cancellation by Kinda Special

If Kinda Special cancels an event and does not provide an appropriate replacement date or alternative agreed with the participant, the ticket price will be refunded.

Kinda Special is not responsible for independently booked travel, hotels, transport or other external costs except where liability exists under mandatory law.

13. Events Affected by Circumstances Outside Our Control

Where an event cannot take place as planned due to circumstances outside Kinda Special’s reasonable control, including official restrictions, severe weather, venue closures, strikes, transport disruption or comparable circumstances, Kinda Special may postpone, relocate or reasonably modify the event where legally permissible.

Any statutory rights of participants remain unaffected.

14. Conduct at Events

Participation is subject to the Kinda Special Community Standards contained in the General Terms.

Kinda Special may refuse admission or require a participant to leave where reasonably necessary due to serious misconduct, safety concerns or violations of the Community Standards.

Where exclusion results from the participant’s own serious misconduct, there is no entitlement to reimbursement to the extent legally permissible.

15. Relationship to Other Terms

The Kinda Special General Terms & Conditions additionally apply.

For Members, the Kinda Special Membership Terms also apply to the Membership relationship.

In the event of a conflict concerning the purchase, cancellation or use of an Event Ticket, these Event Ticket Terms take precedence.
